Fortnite maker Epic Games: Apple has ‘no rights to the fruits’ of our labor

In Epic Games’ latest filing in its war against Apple, the Fortnite developer says Apple has “no rights to the fruits of Epic’s labor,” in reference to Apple’s demands that it be able to take commission on in-app purchases on iOS.

In a filing made Friday, Epic argued that its action represent a “far cry from the tortious — even purportedly criminal — conduct that Apple’s Opposition depicts. Simply put, Epic did not ‘steal’ anything that belonged to Apple.”

It continues that: “Apple’s repeated assertions of theft boil down to the extraordinary assertion that Epic’s collection of payments by players of Epic’s game to enjoy the work of Epic’s artists, designers, and engineers is the taking of something that belongs to Apple.”

Epic Games vs. Apple

Apple and Epic’s battle kicked off in August when Epic established a way to let users circumvent the App Store to buy Fortnite in-app purchases. This was intended to save Epic from having to pay Apple the 30 percent cut it demands via the App Store.

In the aftermath, Apple made the call to boot Fortnite from the App Store. Epic immediately responded with a lawsuit taking aim at Apple for its allegedly monopolistic behavior. The two companies have been fighting back and forth since then. While Epic frames it as a fight about freedom, however, Apple put it in simpler terms. In a court filing made in September, Apple argued that, “Epic’s lawsuit is nothing more than a basic disagreement over money.”

Apple and Epic Games will go to trial in summer 2021.
